Abstract

In this study, we examine the guarantees or immunities provided by the Libyan legislator to ensure that the notification process is effective and achieves its intended purpose. The legislator surrounded the notification with several guarantees, which are represented in the fact that the document is delivered to the person to be notified personally. However, he (the legislator) was aware at the same time that there are cases in which it is impossible to deliver the notification to the person to be notified personally. Therefore, he allowed the notification to be done by delivering the document to one of the persons he mentioned exclusively (such as the agent, the husband and wife, relatives, or in-laws). If all of that is impossible, he allowed the notification to be delivered to the administrative authority.
