Restricting the effects of a ruling of unconstitutionality to protect legal security
Abstract
Legal security is an essential element of a country governed by the rule of law, ensuring stability and development. The clarity and consistency of legal rules is necessary to achieve a balance between state power and the rights and freedoms of individuals. Achieving legal security requires effective constitutionalism that limits the retroactive effect of unconstitutional provisions to prevent harm to individuals. The role of the Libyan constitutional judiciary in achieving legal security and restricting retroactive effect was discussed using a descriptive methodology and comparative constitutional judiciary rulings. Legal solutions must be developed to ensure legal security while monitoring the constitutionality of laws.
