Towards a disciplined mechanism for fatwa on Hajj issues
Abstract
Because Hajj is an act of worship, its issues are regulated by legal texts, leaving only a narrow scope for ijtihad. However, there remain issues that require a fatwa, either because they are new, or because the pilgrim does not know the ruling on them, and for this reason he needs a mufti to inform him of their legal ruling. In view of the great deficiency in controlling fatwas on Hajj issues, a mechanism has been proposed in this research that combines the texts and their objectives, with making it easier for those seeking fatwas, while taking into account the principles of Imam Malik’s school of thought and the circumstances of time and place.
