The organization of the armed forces and their role in protecting the state's territory and securing its borders from a constitutional perspective
Abstract
Any country that wants to preserve its sovereignty and strives to achieve security and stability must have armed forces that possess the material strength to confront any threat to its sovereignty or national security. The primary mission of the armed forces is to defend and preserve the country's independence, protect its national sovereignty and the integrity of its land, sea, and airspace, secure its borders, and safeguard its vital interests from any internal or external aggression or threat.
Therefore, countries are keen to organize their armed forces by stipulating them in constitutions, and defining their tasks and duties in a clear and precise manner, which is what drives us through this study to search for the mechanism of the constitutional construction and organization of the military institution in Libya since the adoption of From the country's first constitution in 1951 to the draft Libyan constitution of 2017, the chapter then addresses the role of the military institution in protecting and securing the country's borders, based on its constitutionally mandated duties of defending the homeland, preserving the country's security and territorial integrity, and preventing any interference in the country's internal affairs, political decisions, or infringement of its national sovereignty.
