Abrogation in the Holy Qur’an and its Impact on Addressing Contemporary Issues: An Analytical Descriptive Study

Abstract

This research aims to highlight the concept of abrogation (Naskh) in the Holy Qur’an and elucidate its impact on addressing contemporary issues. Abrogation plays a pivotal role in providing Sharia with the necessary flexibility to confront modern challenges. The research problem lies in the deficiency of previous studies in linking the impact of abrogation to the resolution of contemporary matters. Adopting an analytical descriptive methodology, the study defines the concept and pillars of abrogation, analyzes its objectives, and demonstrates its influence on modern jurisprudence.

The researcher reached several significant findings, including: the term "transfer" (Naql) is more precise in defining abrogation, as it signifies the shifting and modification of rulings to serve the public interest (Maslaha). Furthermore, the Hanafis' perspective on abrogation serves the believer's creed (Aqidah) more profoundly than the majority  ا definition, which focuses primarily on legal rulings. Abrogation is a legislative tool that prevents the stagnation of Islamic law, ensuring it remains capable of absorbing technological and social developments by offering solutions characterized by realism, mercy, and facilitation. Ultimately, "interest-based abrogation" constitutes the legal foundation for the maxim: "Rulings change with the change of times."
