Neighbor pre-emption and rule "No harm, no foul"
Abstract
The right of pre-emption is a system that derives its provisions from Islamic law, which is its material and historical source. Islamic jurisprudence was keen to regulate the rules and provisions of pre-emption beyond all statutory laws. The provisions of Islamic Sharia were built on the basis of caring for the interests of the people in the present and in the future, bringing benefits to the people, and warding off harm from them. The rule of “no harm, no harm” is considered one of the most important jurisprudential rules for dealing with an important matter that Islamic Sharia takes care of, which is preventing and repelling harm.
