The role of punitive compensation in addressing privacy violations: In French and Libyan law

Abstract

This research examines punitive compensation as a newly developed mechanism for addressing privacy violations through media and the internet within the French legal system, exploring its applications and the potential for its adoption in Libyan law. The research reviews the traditional and punitive functions of civil compensation, presenting the foundations and criteria used by the French judiciary in assessing compensation for moral damages. It also discusses the jurisprudential and judicial developments in France that advocate for the adoption of punitive compensation as a deterrent against deliberate acts motivated by profit.
