The legality of audio recording as evidence in Libyan criminal law
Abstract
As a result of technological development, new means of communication have emerged that facilitate transactions between individuals, but on the other hand, they are considered a fertile field for committing crimes, as this development has contributed to the creation of methods and means that the criminal judge relies on to form his belief in criminalizing patterns of behavior and imposing punishment, with the help of electronic evidence, which has resulted in a jurisprudential difference regarding the extent of the legitimacy of using {audio recording} in criminal evidence, which necessitated that the procedure be carried out according to specific controls in order to achieve a kind of balance between the interest of society and ensuring the preservation of individual freedoms, and this is what made us wonder about the position of the Libyan legislator on evidence derived from audio recording in criminal evidence.
